First, not just anyone can contest a will. You must be what’s known as an “interested party.” In plain English, this means you’re someone who would have received something (an “inheritance”) if an older version of the will was used, or if there was no will at all and North Carolina’s standard rules for dividing an estate were applied.
It’s also crucial to be aware of the time limits. You have three years from the date the will goes through the probate process. If you’re past that three-year mark, it’s usually too late to bring a case.
