Without a plan, the state decides what happens to your assets—and those default rules rarely reflect your personal wishes. Estate planning gives you the control over who inherits your property, who makes decisions on your behalf, and how your legacy is preserved.

“What you’re really protecting with your estate plan is your family,” says Attorney Haley Matson. “Yes, you’re protecting your assets—but you’re also safeguarding your loved ones from legal confusion and unnecessary hardship.”

A thoughtful estate plan can:

  • Appoint a guardian for your children

  • Designate beneficiaries for financial accounts

  • Establish medical and financial powers of attorney

  • Clarify end-of-life wishes with a living will

What Happens If You Don't Plan?

If you die without an estate plan, your assets will go through intestate probate—a court-supervised legal process to settle your estate. That means:

  • Your family must wait out a 90-day creditor claim period

  • Any outstanding debts—including medical bills—can be collected from your estate

  • Your home or other property may be sold to pay those debts

This is how many families lose cherished homes or farmland: not through mismanagement, but because no legal protections were in place.

Planning Helps You Access Long-Term Care Benefits
