When Something Just Doesn’t Feel Right:
Protecting Your Property and Your Family
Attorney Jordan McIntyre
At McIntyre Elder Law, we often meet families at a difficult moment. A loved one says something is missing. A document appears that no one remembers signing. A home or asset has been transferred, and the explanation does not make sense.
These situations are more common than people realize, and they deserve to be taken seriously.
The Reality We See Every Day
We regularly handle cases where:
- An elderly parent signs a deed or legal document they did not understand
- A family member or third party becomes involved in finances or property later in life
- Assets are transferred in a way that does not reflect long-standing wishes
- There are concerns about dementia, confusion, or outside influence
Sometimes the issue is a misunderstanding. Other times, it is something more serious.
Not Every Signature Tells the Whole Story
Just because a document is signed and recorded does not mean it is valid.
North Carolina law allows documents to be challenged when:
- A person lacked the mental capacity to understand what they were signing
- Someone exerted undue influence over them
- The document was obtained through fraud or deception
In these situations, the court can step in and correct what has happened.
How We Help
Our litigation team focuses on protecting individuals and families when something has gone wrong. This includes:
Setting Aside Deeds and Transfers: If property was transferred improperly, we can bring an action to set aside the deed and restore ownership.
Quiet Title Actions: We resolve title issues and remove improper claims so ownership is clear and secure.
Estate and Trust Litigation: We challenge or defend wills, trusts, and beneficiary designations when they do not reflect a person’s true intent.
Guardianship and Capacity Issues: When someone can no longer protect themselves, we help families take the legal steps necessary to ensure their safety and financial protection.
Acting Early Matters
One of the biggest mistakes we see is waiting too long.
Documents get recorded. Property can be transferred again. Memories fade. Witnesses become harder to locate.
If something feels off, it is worth having it reviewed now rather than trying to unwind it later.
Our Approach
We understand that these cases involve family, not just legal issues. Our goal is to:
- Get clarity on what actually happened
- Protect our client’s rights and property
- Resolve the issue as efficiently as possible, whether through demand or litigation
In many cases, we can address the problem early with a demand and avoid a full lawsuit. When that is not possible, we are prepared to take the matter to court.
If You See Red Flags
If you or a family member:
- Signed something you did not fully understand
- Do not remember signing documents involving property or finances
- Believe someone may have taken advantage of a vulnerable situation
It is worth having a conversation.
You do not have to figure it out alone.
